Legal agreements between group companies (often called ‘Intercompany agreements’ or ‘ICAs’) are an intrinsic part of Transfer Pricing compliance – a fact which is highlighted by the OECD’s Transfer Pricing Guidelines.
The contractual allocation of risk cannot be backdated, meaning that ICAs need to be implemented in advance, not as part of the year end process. This is particularly relevant during times of disruption, when the transfer pricing and legal design of internal supply chains may need to be adjusted or rewritten.
